each other online. MuslimMatch.com is provided by MuslimMatch.com, whose
address is FREEPOST LON 6993, London E17 8BR UK.
By using MuslimMatch.com you agree to the following service agreement. This
is a legal agreement ("Agreement") between you and MuslimMatch.com. Please
read the Agreement carefully before registering for the MuslimMatch.com
service. By registering for MuslimMatch.com, you become a member of the
Service (a "Member"), and you agree to be bound by the terms and conditions
of this Agreement (the "Agreement") for as long as you continue to be a
Member.
Summary of
Agreement This service is for adults only. You must be at least
18 years old to register.
You agree to: (a) provide true, accurate, current and complete information
about yourself as prompted during the registration and profile making process,
including but not limited to the sign up form; and (b) to maintain and update
this information to keep it true, accurate, current and complete
You agree not to use the service for illegal purposes or for the transmission
of material that is unlawful, harassing, libelous, invasive of another's
privacy, sexually and/or racially offensive, abusive, threatening, harmful,
vulgar, obscene, tortious, or otherwise objectionable, or that infringes
or may infringe the intellectual property or other rights of another.
You agree not to use the service for the transmission of "junk mail," "spam,"
"chain letters," or unsolicited mass distribution of email or for any commercial
purposes.
You agree to be responsible for your interactions with other members. You
agree that MuslimMatch.com is not responsible or liable for content posted
on the service by third parties or members or the conduct of any member.
Content You
are solely responsible for the content or information you publish or display
(hereinafter, "post") on the MuslimMatch.com service, or transmit to other
MuslimMatch.com Members.
You will not post or transmit to other MuslimMatch.com Members or Employees,
any defamatory, inaccurate, abusive, obscene, profane, offensive sexually
oriented, threatening, harassing, racially offensive, or illegal material,
that is offensive to the online community or against any group or individual;
You agree not to post material that exploits people under the age of 18
in a sexual or violent manner, or solicits personal information from anyone
under 18;
You agree not to post instructional information about illegal activities
such as making or buying illegal weapons, violating someone's privacy, or
providing or creating computer viruses;
You specifically agree that MuslimMatch.com is not responsible or liable
for any threatening, defamatory, obscene, offensive or illegal content or
conduct of any other party or any infringement of another's rights, including
intellectual property rights.
Behaviour
You agree not to use offensive behaviour towards other members or use of
foul language in the messages to other members or in the profile
You agree not to impersonate any other person, including but not limited
to any other member of MuslimMatch.com or MuslimMatch.com employee, while
using the Service.
You agree not to harasses or advocates harassment of another person, including
but not limited to any other member of MuslimMatch.com or MuslimMatch.com
employee, while using the Service.
Profile You
will not post in your profile any telephone numbers, street addresses, last
names, URL's or E-mail addresses and other personal identification or location
information
You will not include in your profile any offensive anatomical or sexually
suggestive or connotative language or photographs, including but not limited
to nudity or sexually provocative and explicit language and/or images.
You agree that MuslimMatch.com may delete, modify and edit any content,
messages, photos or profiles (collectively, "Content") without notice that
in the sole judgment of MuslimMatch.com violate the Service Agreement or
will improve the service delivery or which might be offensive, illegal or
that might violate the rights, harm or threaten the safety of other MuslimMatch.com
Employees and/or its Members.

Commercial Activity You
agree that MuslimMatch.com site is for the personal use of individual users
only and may not be used in connection with any commercial endeavors by
you. Organizations, companies and/or businesses are not permitted to become
MuslimMatch.com Members.
You will not engage in advertising to, or solicitation of, other members
to buy or sell any products or services through the Service.
You will not transmit any chain letters or junk E-mail to other MuslimMatch.com
Members.
You will not use the MuslimMatch.com Service or Site for any purpose other
than seeking a match.
Illegal and/or unauthorized uses of the Site, including also, unauthorized
framing of or linking to the Site will be investigated and appropriate legal
action will be taken, including without limitation civil, criminal and injunctive
redress.
You will not engage in commercial activities and/or sales without our prior
written consent such as contests, sweepstakes, barter, advertising, and
pyramid schemes.
It is possible that other MuslimMatch.com Members or users (including unauthorized
users, or "hackers") may post or transmit offensive or obscene materials
on the MuslimMatch.com service and that you may be involuntarily exposed
to such offensive and obscene materials. It also is possible for others
to obtain personal information about you due to your use of the Service,
and that the recipient may use such information to harass or injure you.
You agree that MuslimMatch.com is not responsible for the use of any personal
information that you may choose to disclose on the Service. You are responsible
for information you post on the Site. Please carefully select the type of
information that you post on the MuslimMatch.com service or release to others.
You agree that although MuslimMatch.com can not monitor the conduct of its
Members off the MuslimMatch.com Site, it is also a violation of the agreement
to use any information obtained from the Service in order to harass, abuse,
or harm another person, or in order to contact, advertise to, solicit or
sell to any user without their prior permission.
Copyright
You will not post, distribute or reproduce in any way any copyrighted material,
trademarks, patents or other proprietary information without obtaining the
prior consent of the owner of such proprietary rights and laws including
but not limited to copyrighted work, such as providing pirated computer
programs or links to them, providing information to circumvent manufacture-installed
copy-protect devices, or providing pirated music or links to pirated music
files;
You agree that by posting information or content to any area of MuslimMatch.com,
you automatically grant, and you represent and warrant that you have the
right to grant, to MuslimMatch.com and other MuslimMatch.com Members an
irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to
use, copy, perform, display and distribute such information and content
and to prepare derivative works of, or incorporate into other works, such
information and content, and to grant and authorize sublicenses of the foregoing.
You agree that any material you send to MuslimMatch.com, by email or otherwise,
or that you post in any areas on the Service that are accessible to the
public or MuslimMatch.com's general membership, will be treated as non-confidential
and non-proprietary and MuslimMatch.com may use such material, in whole
or in part, in any medium for any purpose, including but not limited to
the reproduction, disclosure, transmission, publication, broadcast and posting
of such material in advertising and promotions.
Law The Agreement
and the relationship between you and MuslimMatch.com shall be governed by
British law (regardless of conflicts of law principles). You and MuslimMatch.com
agree to submit to the personal and exclusive jurisdiction of British Law.
MuslimMatch.com failure to exercise or enforce any right or provision of
the Agreement shall not constitute a waiver of such right or provision.
You agree that regardless of any statute or law to the contrary, any claim
or cause of action arising out of or related to use of the Service or the
Agreement must be filed within one (1) month after such claim or cause of
action arose or be forever barred. If any provision of this Agreement is
held invalid, the remainder of this Agreement shall continue in full force
and effect.
Changes to
Agreement You agree that MuslimMatch.com may change the Agreement
from time to time. You will be informed of any such changes on the Site.
Your continued use of the Service after MuslimMatch.com has posted such
notice constitutes your acceptance of any changes.
Changes to
Service You agree that MuslimMatch.com reserves the right to modify
or discontinue, temporarily or permanently, any part of the Service with
or without notice to you. You agree that MuslimMatch.com shall not be liable
to you or any third party for any modification or discontinuance of the
Service
Resale You
agree not to resell the Service or use of or access to the Service. Your
membership in the MuslimMatch.com service is for your sole, personal use.
You may not authorize others to use your membership, and you may not assign
or otherwise transfer your account to any other person or entity.
Prize Draw
No purchase is required. No entrant may win more than one prize, and the
prize must be accepted as offered. Three (3) unique email addresses must
be supplied in full to validate each entry. No responsibility can be taken
for lost or invalid entries. The prize draw is open to all our web site
visitors and members over the age of 18. Each entry must contain three unique
email addresses. Email addresses cannot be duplicated across multiple entries.
Entries containing a fake, non-existent or duplicate email address or belonging
to a person not of the Islam religion will be invalid. The prize draw will
take place every month at a date determined by MuslimMatch.com. The The
decision is final and no correspondence will be entered into. The winner
will be notified by email. No cash alternative is available.
Indeminity
You agree to defend, indemnify, and hold harmless MuslimMatch.com and each
of its stand-alone services, its parent, its subsidiaries, affiliates, officers,
agents and other partners and employees officers, directors, employees,
agents and third parties, for any loss, liability, claim or demand, losses,
costs, liabilities and expenses (including reasonable attorneys' fees) asserted
by any third party due to or arising out of your use of the Service in violation
of this Agreement and/or arising from a breach of these Terms of Use and/or
any breach of your representations and warranties set forth above.
Proprietary
Rights You agree that MuslimMatch.com owns and retains other proprietary
rights in the MuslimMatch.com service. The Service contains the copyrighted
material, trademarks, and other proprietary information of MuslimMatch.com,
its licensors and licensees. In addition, other Members may post copyrighted
information, which has copyright protection whether or not it is identified
as copyrighted. Except for that information which is in the public domain
or for which you have been given permission, you will not copy, modify,
publish, transmit, distribute, perform, display, or sell any such proprietary
information.
Third
Party Arrangement You agree that any correspondence, transactions
or other dealings with advertisers, partners, retailers or vendors or other
third parties available on or linked through the Service, including but
not limited to payment and delivery of related goods or services, and any
other terms, conditions, warranties or representations associated with such
dealings, are solely between you and such advertiser, partner, vendor or
other third party.
MuslimMatch.com does not endorse and is not responsible or liable for any
content, advertising, products, or other materials on or available from
such parties or resources. You agree not to hold MuslimMatch.com liable
for any loss or damage of any sort incurred as the result of the presence,
availability or non-availability of the advertisers, partners, vendors or
other third parties available on or through the Service, or as the result
of any dealings with such parties, including but not limited to attendance
at events advertised or purchase or use of goods or services offered on
or through the MuslimMatch.com site.
Information
Supplied MuslimMatch.com will keep confidential all information
supplied by you to MuslimMatch.com and shall use or disclose such information
only for the purposes for which such information was collected, or as required
by law. You agree that MuslimMatch.com has no access to credit card numbers
and other card details. MuslimMatch.com has no involvement in the online
credit card transaction process. Security and liability for this process
is with specialist service provider WorldPay.
Termination
You agree that MuslimMatch.com may, in its sole discretion, terminate or
suspend your access to all or part of the Service for any reason, including,
without limitation, breach of the Agreement or any subsequent modifications,
or attempted assignment of your account.
You acknowledge and agree that termination may be effected without prior
notice, and acknowledge and agree that MuslimMatch.com may immediately delete
files in your account and bar any further access thereto. MuslimMatch.com
shall not be liable to you or any third party for the termination of Service
or any claims related to the termination of Service. Any suspected fraudulent,
abusive or illegal activity may be grounds for termination of your account
and may be referred to appropriate law enforcement authorities.
You agree that MuslimMatch.com reserve the right to terminate the privileges
of any user who uses this Site to distribute copyrighted material without
a license, express consent, valid defense or fair use exemption to do so.
In particular, users who submit content, whether articles, images, stories,
software or other copyrightable material must ensure that the content they
upload does not infringe the copyrights nor other rights of third parties
(such as privacy or publicity rights). After proper notification by the
copyright holder or agents, and confirmation through court order or admission
by the user that they have used the Site as an instrument of unlawful infringement,
we will terminate the infringing users' rights to use and/or access to this
Site. We may also in our sole discretion decide to terminate a user's rights
to use or access to the Site prior to that time if we have a good faith
belief that the alleged infringement has occurred.
Please report any violations of the Service Agreement by email to info@MuslimMatch.com
Should you object to any terms of the Agreement, or any subsequent changes
to the Agreement, or become dissatisfied with the Service in any way, your
only recourse is to immediately: (1) discontinue and terminate your membership
with the Service; and (2) notify MuslimMatch.com of termination in writing
to the above address. All purchases are final. No refund will be given for
unused portions of Membership period.
Complaints
To resolve a complaint or dispute relating to the MuslimMatch.com Site and/or
Service you will contact info@MuslimMatch.com
in the first instance. Any unresolved matter shall be brought to a binding
arbitration at the discretion of MuslimMatch.com management, in accordance
with British Law and all such arbitration and personal jurisdiction shall
take place in United Kingdom.
The section titles in the Agreement are for convenience only and have no
legal or contractual effect.
Disclaimer
of Warranties The Service and the materials available on or through
the Service are provided "as is" and "as available" and without warranties
or conditions of any kind either expressed, implied statutory in any communication
with MuslimMatch.com or its representatives, or otherwise with respect to
the service. To the fullest extent permissible under applicable law,
MuslimMatch.com does not represent or warrant that the materials or the
results of the use of the materials available through the Service or from
third parties will be correct, accurate, timely, reliable or otherwise nor
for the conduct of any User and/or Member of the MuslimMatch.com Service
whether online or offline.
MuslimMatch.com assumes no responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications line
failure, theft or destruction or unauthorized access to, or alteration of,
User and/or Member communications.
MuslimMatch.com is not responsible for any problems or technical malfunction
of any telephone network or lines, computer on-line-systems, servers or
providers, computer equipment, software, failure of email or players on
account of technical problems or traffic congestion on the Internet or at
any website or combination thereof, including injury or damage to Users
and/or Members or to any other person's computer related to or resulting
from participating or downloading materials in connection with the MuslimMatch.com
Site and/or in connection with the MuslimMatch.com Service.
MuslimMatch.com guarantees that mailbox messages sent by Members will be
processed by the MuslimMatch.com system and sent to the recipient. Notwithstanding,
MuslimMatch.com does not guarantee a response from the recipient nor does
it make any other promises or warranties of any kind.
You agree the MuslimMatch.com Site and/or Service is in beta-mode and delivered
on 'as-seen' basis. Service interrupts, missing links or pages, inaccessible
periods, database and error messages may appear at any time. If you experience
any beta-related issues please contact technical@MuslimMatch.com
You agree that MuslimMatch.com cannot guarantee a minimum uptime or performance
level. Site and/or Service errors or period of inaccessiblity are likely
at any time.
Limitation
of Liability To the fullest extent possible under applicable law,
MuslimMatch.com shall not be liable under any circumstances including negligence,
for any direct, indirect, incidental, special or consequential damages (including,
but not limited to, damages for loss of data, loss of programs, cost of
procurement of substitute services or service interruptions) that result
from the use of or inability to use the MuslimMatch.com service, any changes
to the service, unauthorized access to or alteration of your transmissions
or data, any material or data sent or received or not sent or received,
or any transactions entered into through the Service even if MuslimMatch.com
or its agents or representatives know or have been advised of the possibility
of such damages or (ii) to any person other than you.
Notwithstanding anything to the contrary contained herein, MuslimMatch.com.
liability to you for any cause whatsoever, and regardless of the form of
the action, will at all times be limited to the amount paid, if any, by
you to MuslimMatch.com, for the service during the term of membership.
MuslimMatch.com does not screen the Members registering to the MuslimMatch.com
Service. Therefore, MuslimMatch.com cannot be held responsible for any damages,
direct, indirect, incidental and/or consequential arising out of the use
of this service, including without limitation, to damages arising out of
communicating and/or meeting with other Members of the MuslimMatch.com Service,
or introduced to you via the MuslimMatch.com Service. Such damages include
without limitation, physical damages, bodily injury and/or emotional distress
and discomfort.
MuslimMatch.com reserves the right but has no obligation to monitor the
materials posted in the public areas of the MuslimMatch.com Service. MuslimMatch.com
shall have the right to remove any such material that is in its sole opinion
violates or is alleged to to violate the law or this Agreement. Notwithstanding
this right of MuslimMatch.com, you remain solely responsible for the content
of materials you post on the MuslimMatch.com Service and in your private
Mailbox messages. Emails sent between you and other MuslimMatch.com Members
that are not readily accessible to the general public will be treated as
private by MuslimMatch.com to the extent required by applicable law.
This Agreement, accepted upon use of the Site and further affirmed by becoming
a Member of the MuslimMatch.com service, contains the entire agreement between
you and MuslimMatch.com regarding the use of the Site and/or the Service.
If any provision of this Agreement is held invalid, the remainder of this
Agreement shall continue in full force and effect.
IF YOU DO NOT AGREE WITH THE TERMS LISTED IN THE AGREEMENT, PLEASE DO NOT
REGISTER FOR THE MUSLIMMATCH.COM SERVICE. THE TERMS ARE SUBJECT TO CHANGE
BY MUSLIMMATCH.COM AT ANY TIME.
